Justice Department says secrecy needs bar ACLU surveillance suit

DETROIT The Bush administration today asked a federal appeals court to toss out a lawsuit challenging a warrantless surveillance program.

The American Civil Liberties Union sued the National Security Agency in Detroit federal court.

It sued in January on behalf of journalists, scholars and lawyers who say the surveillance has made it difficult for them to do their jobs.

A Detroit federal judge ruled in August that the warrantless spying program is unconstitutional.

The Bush administration appealed, and it told appeals judges in Cincinnati that government can't defend itself without revealing national secrets.
